AtomCare provides home-based healthcare services, care coordination, consultations, rehabilitation support, palliative care assistance, diagnostics facilitation, and related non-clinical support.

AtomCare does not operate as a hospital or emergency medical service provider.

3. Acceptance of Electronic Communication

By using the Services, you consent to receive communications from AtomCare electronically, including emails, calls, messages, or notifications related to care coordination, service updates, appointments, or administrative matters.

4. Healthcare Disclaimer

Information provided through the Services:

• Is not a substitute for emergency medical treatment
• Does not replace in-person medical examination where clinically required

Users are advised to seek immediate medical attention from emergency services when necessary.

5. User Responsibilities

You agree to:

• Provide accurate, complete, and truthful information
• Share medical records and prescriptions only if authorised to do so
• Inform AtomCare of any changes in patient condition that may affect care delivery
• Use the Services only for lawful purposes

AtomCare is not responsible for outcomes arising from inaccurate or incomplete information provided by users.

6. Medical Documents and Prescriptions

By uploading or sharing medical documents, you confirm that:

• You are authorised to disclose such information
• The documents are accurate to the best of your knowledge
• The documents are shared solely for the purpose of obtaining healthcare services

AtomCare reserves the right to decline services where documentation is insufficient or clinically inappropriate.

7. Consent to Data Processing (DPDP Compliance)

By using AtomCare's Services or submitting information through forms, you provide free, specific, informed, unconditional, and unambiguous consent for the collection, processing, storage, and sharing of your personal and health-related data in accordance with the Digital Personal Data Protection Act, 2023 and our Privacy Policy.

You acknowledge that:

• AtomCare acts as a Data Fiduciary
• Health and medical data is processed solely for care delivery and coordination
• Consent may be withdrawn at any time, subject to legal retention requirements

8. Pricing, Payments, and Service Modifications

All prices displayed are indicative and subject to change based on individual care needs, duration, clinical complexity, and services selected.

Final pricing will be confirmed after assessment and before service commencement.

AtomCare reserves the right to modify, suspend, or discontinue services with reasonable notice where required.

9. Cancellation and Service Refusal

AtomCare reserves the right to:

• Decline or discontinue services if they are clinically inappropriate, unsafe, or unlawful
• Suspend services for non-payment, misuse, or violation of these Terms

Refunds, if any, shall be governed by service-specific agreements.

10. Intellectual Property

All content, trademarks, logos, text, graphics, and materials on the Services are the property of AtomCare or its licensors and are protected under applicable Indian intellectual property laws.

No content may be reproduced, distributed, or used for commercial purposes without prior written consent.

11. Limitation of Liability

To the maximum extent permitted under Indian law:

• AtomCare shall not be liable for indirect, incidental, consequential, or punitive damages
• AtomCare's total liability shall not exceed the amount paid by the user to AtomCare in the 12 months preceding the claim

Nothing in these Terms limits liability for acts prohibited under applicable law.

12. Indemnification

You agree to indemnify and hold harmless AtomCare, its directors, employees, affiliates, and service providers from claims, losses, damages, or expenses arising from:

• Misuse of the Services
• Breach of these Terms
• Submission of unauthorised or inaccurate information

13. Privacy and Data Protection

Your use of the Services is subject to AtomCare's Privacy Policy, which forms an integral part of these Terms. In the event of inconsistency, the Privacy Policy shall prevail with respect to personal data processing.

These Terms shall be governed by and construed in accordance with the laws of India. Courts located in Kolkata, West Bengal shall have exclusive jurisdiction over any disputes.
